An officer with the Isleta Police Department is accused of rapping a woman he arrested last week for driving while intoxicated. Leon Martin, 22, was arrested on Tuesday and charged with criminal sexual penetration, false imprisonment, demanding a bribe, and violating public service ethical principles. Martin’s lawyer was not listed in online court documents as someone who could comment on his behalf.

Martin admitted to having sex with the woman while she was under custody in an interview with NMSP, but said she instigated the meeting and that he made a mistake. Martin had messaged her on Facebook following a previous domestic violence episode, according to the woman. He seemed to be “trying to hit on her,” she stated.

Martin was no longer a police officer for the Isleta Pueblo, according to Governor Vernon Abeita. Martin was arrested when a woman claimed he raped her after a car accident.

“The individual is no longer employed by the pueblo, and the Isleta Police Department is cooperating fully with an ongoing investigation of the incident that is being conducted by New Mexico State Police,” Gov. Vernon Abeita said.

A 21-year-old woman claimed to State Police on Nov. 24 that she had been arrested by Martin a few days before. She was allegedly weaving between the eastbound and westbound lanes of N.M. 47 before colliding with the guardrail. The woman told officers that Martin informed her she could sit in the front seat and didn’t handcuff her, which she thought was because she was wearing a cast on her broken wrist, which had been aggravated by the crash. According to a criminal complaint filed in Metropolitan Court, the woman discovered that Martin had messaged her on Facebook after she had been involved in a domestic violence incident — an exchange she thought was odd – before the stop.

“(The woman) said Officer Martin told her if they spent a longer amount of time together, she would spend a shorter amount of time in jail and would get to see the judge quicker,” an officer wrote in the complaint. “Officer Martin also told her he would speak to the judge to help her out with the DWI charges. (The woman) stated she did not want to have sex with Officer Martin but felt like she had to.”
